The terms governing the use of Inkspo

Inkspo (inkspo.ai) is an AI tattoo design generator: you describe an idea, pick a style, placement and size, and the service produces a design image you can take to a tattoo artist. These Terms of Service ("Terms") govern your use of the website and the service. By using Inkspo you agree to them; if you do not agree, do not use the service.
Inkspo produces design concepts, not tattoos. A generated image is a starting point for a conversation with a professional tattoo artist, who will adapt it to your body, skin and their own craft. We may change, add or remove features of the service at any time.
You must be at least 13 years old to use Inkspo, and at least 18 (or the age of majority where you live) to purchase credits. Getting tattooed is separately regulated where you live; the service does not change any of that.
You do not need an account to generate designs. If you create one, keep your credentials safe: everything done under your account counts as done by you. Give us accurate information when you sign up.
Free use is limited per person and per day, and by a site-wide daily budget; the current numbers are shown in the product. We enforce these limits technically and may adjust them at any time. Circumventing them — for example by rotating identities or automating requests — is a breach of these Terms and can get your access blocked without notice.
Paid use works on one-time credit purchases. There are no subscriptions and nothing renews by itself.
Payments are processed by Stripe; we never see or store your card details.
A "design" means an image the generator produces from your prompt, and any reference image you upload.
You own what you make. You may use the designs you generate for any purpose, personal or commercial, including having them tattooed, and including as a reference you bring to a tattoo artist. We claim no ownership over them.
We may show selected designs. By generating a design you grant us a worldwide, non-exclusive, royalty-free licence to display it, and the prompt that produced it, in our public gallery, in help and example material, and on our social media accounts, in order to show what the service can do. This licence covers display and the reformatting that display requires — resizing, cropping and compression. It does not let us sell your design or licence it to anyone else.
Selection is manual and you can opt out. No design appears publicly unless a person here has chosen it. Write to us at the address below naming the design and we will remove it and not use it again. Removal takes effect on our site promptly; copies already distributed by third parties are outside our control.
Reference images you upload. You must own the image or have permission to use it. Do not upload photographs of a person who has not agreed to it. We use an uploaded reference to produce your design and we do not display it publicly.
No exclusivity. Generated designs are not unique. The same or a similar prompt may produce a similar design for someone else, and we cannot and do not promise otherwise.
AI disclosure. Every design on this service is generated by an AI model. It is a starting point for a conversation with a tattoo artist, not a finished tattoo. We do not warrant that a design is original, that it can be tattooed as drawn, or that it does not resemble existing artwork.

We may remove any content from our systems, and suspend accounts, where our policies or the law require it.
The Inkspo name, site, and everything on it apart from your designs — code, layout, style presets, text — belong to us or our licensors. These Terms do not give you any right to them beyond using the service.
A tattoo is permanent. Inkspo gives you a picture, not medical, dermatological or professional advice. Whether a design can be executed on skin, how it will age, and whether tattooing is safe for you are questions for a licensed tattoo artist and, where relevant, a doctor.
Generating a design means your prompt and any reference image are processed by the AI infrastructure providers we use, and stored images are hosted with our storage providers. We choose providers under contractual confidentiality terms and send them only what the generation needs. Details are in our Privacy Policy.
You can stop using Inkspo at any time. We may suspend or terminate access — including deleting an account — for breach of these Terms, for abuse of the service, or where the law requires it. Sections about ownership, licences, disclaimers and liability survive termination.
The service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free or that any particular generation will meet your expectations. Outputs of AI models are probabilistic; two runs of the same prompt will differ.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose, or 50 US dollars if you paid nothing. Nothing in these Terms excludes liability that cannot be excluded by law.
We may update these Terms. The date at the top is the date of the current version. Material changes will be announced on the site; continuing to use the service after a change means you accept it.
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules, and disputes belong to the courts located there, unless the law where you live grants you mandatory protections that override this.
